Product Recall
Product recalls are most often due to negligence or poor quality control on the part of the manufacturing company. Research and development investment dollars may have been cut and proper testing could have been overlooked. Due to these circumstances, a product recall may have to be issued. Product recalls range anywhere from faulty wiring in toaster ovens to child restraints that restrict breathing. In the US alone, defective products cause close to 30 million injuries and 22,000 deaths annually.
A product is considered defective if it potentially can cause unwarranted injury to the consumer. One of the most notable product recalls pertained to a vehicle that Ford Motor Company manufactured.
Ford Motor Company faced many wrongful death lawsuits that started from a series of vehicle explosions that affected its popular Pinto sedans in the 1970s. The car’s gas tank was designed with a fault rear-facing gas tank that would often rupture in a minor rear end collision. As a result, many “fender benders” resulted in explosion, fire and death. It was the unsafe design of the product that caused these fatalities and therefore Ford Motor Company was liable to the families that lost their loved ones. Eventually the car was recalled.
